ВСТУП

Нормативна навчальна дисципліна „Професійна іноземна мова ” передбачена навчальним планом підготовки фахівців освітньо-кваліфікаційного рівня „магістр” зі спеціальності 8.03040201 „Правознавство”і входить до циклу дисциплін професійно-орієнтованої гуманітарної та соціально-економічнопідготовки студентів.

Курс розрахований на один семестр. Навчання іноземній мови в семестрі є послідовним та логічним продовженням попереднього етапу вивчення мови і охоплює. різноманітну тематику професійного спрямування, а також суспільно-політичну та побутову.

Згідно навчального плану в 9-му семестрі студенти складають залік.

Мета дисципліни: поглиблене вивчення іноземної мови для володіння нею на фаховому рівні, формувати у студентів професійно орієнтовані комунікативні мовленнєві компетенції для забезпечення їхнього ефективного спілкування в академічному та професійному середовищі. Сприяти розвитку здібностей до самооцінки та здатності до самостійного навчання.

Завдання дисципліни: набуття навичок практичного володіння іноземною мовою в різних видах мовленнєвої діяльності в обсязі тематики, зумовленої професійними потребами; одержування новітньої фахової інформації через іноземні джерела; користування усним монологічним та діалогічним мовленням у межах побутової, суспільно-політичної, загальноекономічної та фахової тематики; перекладу з іноземної мови на рідну,текстів загальноекономічного характеру; реферування та анотування суспільно-політичної та загальноекономічної літератури рідною та іноземною мовами.

Вимоги щодо рівня володіння мовою

Студент повинен бути здатним ефективно спілкуватися іноземною мовою у професійному середовищі, щоб:

· обговорювати навчальні та пов’язані зі спеціалізацією питання, для того щоб досягти порозуміння зі співрозмовником;

· готувати публічні виступи з низки великої кількості галузевих питань, застосовуючи відповідні засоби вербальної комунікації та адекватні форми ведення дискусій;

· знаходити нову текстову, графічну, аудіо та відео інформацію, що міститься в англомовних галузевих матеріалах (як у друкованому, так і в електронному вигляді), користуючись відповідними пошуковими методами і термінологією;

· аналізувати англомовні джерела інформації для отримання даних, що є необхідними для виконання професійних завдань та прийняття професійних рішень;

· писати професійні тексти і документи англійською мовою з низки галузевих питань;

· писати ділові та професійні листи, демонструючи міжкультурне розуміння та попередні знання у конкретному професійному контексті;

· перекладати англомовні професійні тексти на рідну мову, користуючись двомовними термінологічними словниками, електронними словниками та програмним забезпеченням перекладацького спрямування.

 

Зміст дисципліни розкривається в темах:

1. Законодавча система України.

2. Письмове ділове спілкування, складання звітів, доповідей та інших інформаційно-аналітичних видів документів.

3. Мовно-комунікативні особливості усних презентацій.

4. Мова наукового стилю.

Методичні рекомендації щодо підготовки до практичних занять.

 

Студент виконує поточну домашню роботу при підготовці до практичних занять, а саме:

1) опрацьовує граматичний та лексичний матеріал;

2) працює над текстами;

3) виконує вправи (граматичні, лексичні та мовленнєві);

4) працює з додатковою навчальною та довідковою літературою (підручниками та довідниками з граматики, словниками).

Особливу увагу студент має приділити роботі над текстами:

· прочитати текст;

· виписати та вивчити незнайомі слова;

· виконати вправи до тексту усно або письмово;

· підготувати анотацію, презентацію.

The Need for Law. Functions of Law. Kinds of Law

The question ‘What is law?’ has troubled people for many years. Scientists devote an entire field of study known as jurisprudence to answering this question. Many definitions of law exist, but for our purposes, we can define law as the set of rules and regulations by which a government regulates the conduct of people within a society. Even with this explanation, many questions arise. Where do laws come from? Do we need laws? Are all laws written? Can laws change? If so, how? What is the difference between laws and morals?

To understand the law, we must consider the relationship of law to morals. Traditional ideas of right and wrong influence our legal system. Thus, most people condemn murder, regardless of what the law says. However, everything that they consider immoral is not necessarily illegal. For example, lying to a friend may be immoral but not really illegal.

One thing is certain: every society that has ever existed has recognized the need for law. These laws may have been written, but even primitive people had rules to regulate the conduct of the group. For a very long time now, members of every community have made laws for themselves in self-protection. Without laws, there would be confusion, fear, and disorder. This does not mean that all laws are fair or even good, but imagine how people might take advantage of one another without some set of rules. We are far better off with the imperfect which we have, than if we had none at all.

Law serves a variety of functions. It helps to maintain a peaceful, orderly, relatively stable society, to contribute to social stability by resolving disputes in civilized fashion, to facilitate business activities and private planning, to provide some degree of freedom that would not otherwise be possible, to inhibit social discrimination and improve the quality of individual life in matters of health, education and welfare. The law is an enabler, something that permits us to enjoy rights within the framework of an ordered society. In many ways law is the cornerstone of our culture. The rule of law provides society with the rules by which all of us live. Citizens can know the law and live their lives accordingly.

Laws fall into two major groups: criminal and civil. Criminal laws regulate public conduct and set of our duties owed to society. A criminal case is a legal action by the government against a person charged with committing a crime. Criminal laws have penalties requiring that offenders be imprisoned, fined, placed under supervision, or punished in some other way.

Civil laws regulate relations between individuals or group of individuals. A person can bring a civil action (lawsuit) when this person feels wronged or injured by another person. Civil laws regulate many everyday situations such as marriage, divorce, contracts, real estate, insurance, consumer protection and negligence.

Науковий стиль – це стиль наукової прози. Мова наукового стилю використовується для написання наукових статей, анотацій, рефератів, доповідей та має за мету доводити гіпотези, створювати нові концепції, розкривати внутрішні закони існування, розвитку, відносини між різними явищами. Task 1. Read and translate the text:

Scientific Prose Style

The language of science is governed by the aim of the functional style of scientific prose which is to prove a hypothesis, to create new concepts, to disclose the internal laus of existence, development, relations between different phenomena, etc. The language means used, therefore, tend to be objective, precise, unemotional, devoid of any individuality, there is a striving for the most generalized form of expression.

The first and the most noticeable feature of this style is the logical sequence of utterances with clear indication of their interrelations and interdependence. It will not be an exaggeration to say that in no other functional style do we find such a developed and varied system of connectives as in scientific prose.

A second and no less important feature and, perhaps, the most, conspicuous, is the use of terms specific to each given branch of science.

The general vocabulary employed in scientific prose bears its direct referential meaning, that is, words used in scientific prose will always tend to be used in their primary logical meaning.

Neutral and common literary words used in scientific prose will be explained even if their meaning is only slightly modified, either in the context or in a foot – note.

In modern scientific prose an interesting phenomenon can be observed such as the exchange of terms between various branches of science. This is evidently due to the interpenetration of science ideas.

A third characteristic feature of scientific style is what we may call sentence – patterns. They are of three types: postulatory, argumentative and formulative. An hypothesis, a scientific conjecture or a forecast must be based on facts systematized and defined.

Therefore every piece of scientific prose will begin with postulatory pronouncements which are taken as self-evident and needing no proof. A reference to these facts is only preliminary to the exposition of the writer’s ideas and is therefore summed up in precisely

formulated statements accompanied if considered necessary, by references to sources.

A fourth observable feature of the style of modern scientific prose, and one that strikes the eye of the reader is the use of quotations and references.

The references also have a definite compositional pattern, namely, the name of the writer referred to, the title of the work quoted, the publishing house, the place and year it was published, and the page of the excerpt quoted or referred to.

A fifth feature of scientific style, which makes it distinguishable from other styles, is the frequent use of foot-notes, not of the reference kind, but digressive in character.

The impersonality of scientific writings can also be considered a typical feature of this style. This quality is mainly revealed in the frequent use of passive constructions. Scientific experiments are generally described in the passive voice.

It should be noted that impersonal passive constructions are frequently used with the verbs «suppose, assume, presume, conclude, infer, point out», as in «It should be pointed out», «It must not be assumed», «It must be emphasized», «It can be inferred».,.

Анотація – це узагальнений, стислий зміст першоджерела (статті, книги тощо). Анотація відображає та дає оцінку важливості науковому та практичному значенню основних моментів першоджерела, характеризує викладену в ньому інформацію. Автор має досконально володіти характерними засобами стилю анотацій та специфічними фразами, які допоможуть стисло, точно та професійно викласти свою думку та дати відповідну оцінку матеріалу першоджерела.

Європейський союз – Україна

Європейський союз (ЄС) – це сім`я демократичних європейських країн, що спільно працюють задля миру та процвітання. Це – не держава, що має замінити існуючі держави, це більше, ніж будь-яка міжнародна організація. ЄС – дійсно унікальне явище. Держави-члени ЄС утворили спільні інструкції, яким делегували деякі зі своїх повноважень, таким чином, щоб рішення щодо окремих спільних питань можна було демократично вирішувати на європейському рівні.

Євро – це єдина валюта Європейського союзу, запроваджена в двадцятьох із двадцяти п’яти його країнах-членів, які складають Єврозону ЄС. Три країни – Велика Британія, Данія та Швейцарія – не погодилися вводити євро в 1999 році.

Спільна стратегія ЄС була ухвалена в грудні 1999 року в Хельсінкі Європейською Радою як розуміння того, що існує потреба у більш тісних зв’язках між ЄС та державами – членами та конкретними країнами-партнерами.

Між ЄС та Україною укладено декілька окремих угод в галузі торгівлі, науки та технології, ядерної енергетики.

План дій ЄС – Україна, що поширюється на ключові сфери, у яких здійснюються відповідні конкретні заходи. Такими сферами є політичний діалог і реформа; торгівля та заходи, спрямовані на підготовку партнерів до поступової участі у внутрішньому ринку ЄС; правосуддя та внутрішні справи; енергетика, транспорт, інформаційне суспільство, охорона довкілля та дослідницько-інноваційна діяльність; а також соціальна політика та культурно-освітні контакти між людьми.

Впізнання

Поліція наділена повноваженнями проводити процедури впізнання відносно арештованих осіб. Прискорити процедуру проведення візуального впізнання підозрюваного можна за допомогою залучення свідка.

При впізнанні особи за офіційними даними допомогти розслідуванню можуть відбитки пальців та фотографії. В інтересах досягнення цілей суддею можуть також відбиратися і зразки з людського тіла.

Впізнання може включати в себе як виявлення тотожності із злочинцем шляхом його зорового сприйняття так і перевірку впізнання підозрюваного щодо його відношення до злочину. За правилом не є кримінально караною відмова від надання відомостей про своє власне ім’я та особливі прикмети. Теоретично це означає, що при впізнанні підозрюваної особи вона може залишатися невідомою включно під час судового розгляду, хоча відбитки пальців та інші належні зразки можуть бути взяті без згоди особи з метою доведення їх тотожності. У даному випадку на відібрані зразки особи слід прикріплювати ярлик з номером.

Протидія телекомунікаційним шахрайствам

За минуле десятиліття з появою персональних комп’ютерів та зручних швидких телекомунікацій у всьому світі, злочинність також отримала розвиток поза межами міжособових стосунків. Сьогодні громадянин може навіть не знати що він є потерпілим до тих пір, поки раптово йому не відмовлять у фінансових послугах, не виставлений стоп-лист на його кредитні картки та надання основних послуг припиняється. Телекомунікаційні шахрайства можуть завдати матеріальної шкоди юридичним або фізичним особам, якщо неконтрольовані дії окремих осіб будуть продовжуватись.

На даний час розслідування цих злочинів може бути не здійснено, враховуючи їх складний та високотехнічний характер. Більшість працівників не володіють знанням щодо термінології у галузі телекомунікацій. Існує досить мало можливостей щодо проведення повного розгляду у цій складній сфері.

Є кілька визначених джерел для підготовки протидії телекомунікаційним злочинам, таких як таємна служба Сполучених Штатів (USSS) або практичний досвід працівників, які діяли у відповідних ситуаціях, розслідуючи кримінальні справи. Багато поліцейських управлінь все ще є некомпетентними щодо їх обов’язків у цій сфері та не знайомі з необхідними механізмами щодо ініціалізації всебічного розгляду, коли вчиняються телекомунікаційні злочини.

Title - The Prevention and Control of Robbery

Abstract – This project consists of a series of substudies on the robbery problem. The substudies include a detailed study of police response to robbery, a statistical analysis of the robbery system as a whole, a study of the geography of robbery (determining in detail the location of robberies and how location relates to possible methods for control), a study of the offenders and robbery (including the ideas held by offenders for prevention and control), a study of street robbery, studies of other specific kings of robbery, an evaluation of improved police practices and other innovations in robbery control, a study of the role of the courts, corrections, and other criminal justice agencies and a study of the impact of legal decisions upon robbery.

Title – Graduate Research Fellowship Program

Abstract – Forty-two graduate research fellowships have been awarded for the 1970-71 academic year. Recipients will devote their doctoral research to a problem in the field of law enforcement or criminal justice. The award provides for a first jear stipend of $2,600 and $600 for each dependent. A concomitant award of $3,500 is made to the school attended by the selected fellow to defray the cost of tuition, fees and academic allowances.

4. САМОСТІЙНА РОБОТА СТУДЕНТІВ

 

4.1. Методичні рекомендації до виконання самостійної роботи

 

Самостійна робота студентів передбачає самостійне опрацювання тем, винесених на самостійне вивчення. Зміст самостійної роботи з дисципліни визначається навчальною програмою дисципліни.

При роботі з текстом рекомендується:

· прочитати текст;

· виписати та вивчити незнайомі слова;

· перекласти текст усно або письмово;

· поставити запитання до тексту та відповісти на них;

· переказати текст (передати його зміст), виконати вправи до тексту усно або письмово;

· підготувати анотацію, презентацію.

Окрім текстів, студент опрацьовує граматичний та лексичний матеріал уроків/розділів та виконує вправи (граматичні, лексичні та мовленнєві).

Під час опрацювання матеріалу рекомендується користуватися додатковою навчальною та довідковою літературою (підручниками та довідниками з граматики, словниками).

Вимоги до виконання самостійної роботи

При роботі з текстом студенти повинні уміти:

· узагальнити викладені факти;

· співвіднести окремі частини тексту (представити викладені події у певній послідовності, згрупувати факти, установити зв’язок між подіями);

· сформулювати на основі фактів тексту власне судження у вигляді висновку;

· оцінити викладені факти;

· підтримувати бесіду по прочитаному.

Крім того, студенти повинні уміти складати іноземною мовою ділові листи, факси, імейли, службові записки, доповіді.

 

Самостійна робота студента контролюється, перевіряється та оцінюється викдадачем.

Task 1. The text for discussion. Read the following text and try:

to explain the need for rules; to develop a list of guidelines for good rules; discuss laws in your life.

 

World of Rules

A rule is a guideline for behavior. It is meant to manage the way a person acts or does something. For example, there are rules in the game of baseball. These rules tell baseball player how to play the game of baseball. They tell the players what they can and cannot do. Rules may be written or unwritten. They may also be started by habit or custom. For example, it is a rule in my house that we must eat dinner, at the table, together. We cannot watch television while eating. This is a family custom or habit.

Good rules are helpful, and bad rules are sometimes confusing. For example, ‘Do not run in the swimming pool area’ is a good rule because it protects people from getting hurt. ‘Be friends with everyone in class’ is not a good rule because it is not reasonable to order friendships. How will a teacher know if students are actually friends? Also, should there be a punishment for people who are not friends? What makes these rules good or bad?

A. Rules should be clear and easy to understand. B. People should be able to do what the rules say. C. Rules should not conflict with other rules. D. Rules should be enforceable. E. There should be a penalty for breaking rules. F. Rules should be explained to people or written in a place where everyone can see them.  

 

Many places in your community have rules. In shopping malls, for example, people are not allowed to run or play loud radio music. What is the purpose of these rules? Can you think of other places where there are rules? What are some other rules? Why do you think these rules were made?

Laws are rules which are set and enforced by a government. They protect people and help people get along with each other. Laws are written by the government for the entire community. They are out in a code or law book. Every town or city has laws. Imagine what community would be like without laws. What might happen in a community where there are no laws?

Rules Laws
A rule is a guideline for conduct or action. Rules may be written or unwritten. They may be started by habit, custom, or written guideline. A law is written by the government.
A rule is enforced by the people who make the rule. A law is enforced by the police, sheriff, state patrol, FBI, etc. These groups are called law enforcement.
If you break a rule, you can lose privileges. If you break the law, you can be punished by the government, lose privileges or money, and go to jail.
